Legal and administrative framework

For the most part, in regards to economy, Togo’s legal and administrative framework aligns with the legislations of WAEMU, ECOWAS, or more global ones.

Hence, Togo’s business law falls under the OHADA (Organisation for the Harmonisation of Business Law in Africa) treaty that regroups 17 countries : those of the WAEMU and CEMAC, and also Comoros, Guinea Conakry and the Democratic Republic of Congo.

In terms of finances, Togo depends on sub-regional institutions, namely the Central Bank of West African States (BCEAO) which is based in Dakar. Financial market regulation in insured by the Regional Public Savings and Capital Markets Council (CREPMF) headquartered in Abidjan.

The Togolese insurance market is subjected to the rules of the CIMA (Inter-African Conference on Insurance Markets) zone.

Regarding intellectual property, Togo relies on the African Organisation for Intellectual Property (OAPI).

Most of the legislation and guidelines applied in these various legal and administrative spaces are available on www.droit-afrique.com, under the Togo section.

At a global level, Togo is a member of the United Nations (UN), the World Trade Organization (WTO) or the International Renewable Energy Agency (IRENA).

In Africa, the nation is also member of the Conseil de l’Entente, the Electric Community of Benin (CEB), the African Peer Review Mechanism (APRM), the Co-Prosperity Alliance Zone (COPAZ) and obviously the African Union (AU).
